ᐅ Height restriction in the land use plan (building permit / planning permission)

Hello,

my name is Micha, and I am new here. I am about to buy a house with an additional plot of land that I plan to develop in the future. The development plan looks like this:

According to the plan, a two-story building with a height limit is permitted. When I look at the text section, it states:

For single-story buildings, the height of the exterior walls - measured from the intersection of the roof covering over a single-family house (see point 3.2) - may be up to 3.15m (10 feet 4 inches). For buildings that are not necessarily two stories, the height must not be less than 4.30m (14 feet 1 inch) (exterior wall as above).

I don’t fully understand this. So, for one full story (+ attic), my exterior wall can be 3.15m (10 feet 4 inches) high (from the single-family house up to the roof covering). But what about two full stories? What is the maximum height allowed for the building?

Sorry if this is a silly question; I haven’t been reading development plans for very long.

Does the development plan include several areas, with some allowing single-story buildings and others two-story buildings, like in your case?
Then the written version also covers the other plots.

At least 4.30 m (14 ft), since your plot is located in an area where two storeys are permitted but not mandatory (otherwise there would be a specific zone indicating the number of storeys).
However, it would be helpful to have the entire development plan. Taken out of context, this regulation does not make sense to me.

Thanks for your replies. Things are a bit busy right now, and we’re in a critical phase with everything. We currently have to clarify a lot with various people.

This is an established residential area that has existed for 30 years. The plot to the left of the marked one is already developed with a three-family house that has two full stories plus an attic. We would be purchasing this house, which has the following height:

In my opinion, a height requirement of “at least 4.30 m (14 feet)” doesn’t make much sense. What if I build a 20 m (66 feet) complex there? That’s why I’m a bit confused. All the surrounding houses are mostly one story, and the two-story house already stands out. I just want to make sure there are no unpleasant surprises. I would like to eventually build on the plot, preferably with two full stories.

That’s what I’m saying. By itself, it’s hard to understand. But if you don’t make the entire development plan available here, we can only explain what you quote.

Subject to other regulations, that would be possible. But then the floor heights would have to be at least 6m (20 ft), which hardly anyone would reasonably plan or pay for. Well, you’d first have to check the building code in force 30 years ago regarding the definition of a full story, to see whether stacking non-full stories was still allowed back then. Also, every (building) regulation I know of includes a clause against disfigurement (in Baden-Württemberg §11), which can be used if necessary to prevent urban planning disasters.

Thank you for your help. This is the first development plan I have to read, and I don’t want to make any mistakes. Since the adjacent property was built with 2 full floors within the same building envelope, everything should be fine. Only the minimum height caught my attention. The height requirement makes sense when you consider that only 2 full floors are allowed to be built—then a 30m (98 ft) tall house wouldn’t really make much sense ;-)
