ᐅ Height of privacy screens next to neighboring properties with different ground levels

Hello,

there is a height difference of about 70cm (28 inches) between our property and the neighboring one. Our plot is higher, so we have built a retaining wall at the boundary. Now we want to install a privacy screen on top of this wall.

My question is: how high is the privacy screen allowed to be? We are in Baden-Württemberg, where a privacy screen at the property line is generally permitted up to 1.50m (5 feet) high. But how does this work with a height difference? Should I measure the 1.50m (5 feet) from our higher ground level, or from the lower neighboring property?

As far as I remember (please check the local building code!), the height is measured where the privacy screen is located. In this case, that means on your property. Also, if I recall correctly, unlike a fence, the privacy screen must be placed on your property and not on the boundary line, and it must not be attached to the fence. Otherwise, it becomes part of the fence, which means that the regulations for fences (especially regarding height) would apply to the privacy screen.
