we have purchased a terraced house from a developer. To access the garden, a small garden path was created. It consists of compacted sand with various larger pebbles.
The problem is that this path runs directly along the neighboring property, and the height difference between our path and the neighbor’s land is about 30-50 cm (12-20 inches). Our path was not paved; only some existing bushes/trees provide more or less permanent support.
Additionally, the path behind the houses has quite a steep slope. As a result, rainwater frequently washes away sand, causing a roughly 1-meter (3 feet) long and 10 cm (4 inches) wide trench to clog immediately. Furthermore, water then flows unhindered onto the neighbor’s property.
How can we legally require the developer to address this issue?
Are there any regulations regarding the permanent construction or surfacing of paths?
What about surface water runoff onto neighboring properties?
Also, shouldn’t a drainage channel be connected to a proper drainage system? Ours ends directly in the ground and is supposed to allow the water to infiltrate there.
Are there standard values for rainfall amounts per square meter (sq m) depending on different seasons that need to be considered for planning, based on soil characteristics such as water absorption capacity and infiltration rate?
