Hello everyone,
In our building application, we specified the garage with a height of 2.68 meters (8 feet 9 inches) for some reason. The garage is properly located at the edge of the property on the area designated as GA in the development plan.
Would it be possible to build the garage 3 meters (9 feet 10 inches) high instead, contrary to the application, or do we have to stick to the approved plans? The construction is taking place in Baden-Württemberg.
The question arises because we are quite certain that we will not actually build a garage there. Instead, a carport is planned, which will be greened. Therefore, we would like to make use of the maximum permitted height.

So far, I know that I want a gate (not just a door) on both the front and back sides, so that it’s possible to drive through to the garden in the back if needed. Also, I’d like a green roof with roof windows, since on one side we have to go without windows and on the other side we want to avoid windows. If you do it yourself, the costs, including sectional doors and roof windows, remain manageable.

It’s not a standalone carport in the usual sense, but rather an oversized entrance canopy to allow loading and unloading while staying dry during rain. Additionally, it also serves as a privacy screen on the north side, where there is an unattractive wall about 2m (6.5 feet) high, with the neighbor’s house visible above it. We also want to place trash bins and similar items underneath, well concealed...
So it has a few functions and hopefully will look nice.

But that is exactly what the building authority is interested in (at least in Baden-Württemberg). This prevents traffic obstruction… The 5-meter (5.5 yards) distance is basically mandatory anyway. (Exceptions are regulated by the development plan.) As far as I know, every building code includes the 5 meters in front of the garage. Including Baden-Württemberg! (Section 4, paragraph 1)
Does the building code have specific regulations for electric gates? I’m not aware of any.
Maybe check your development plan?

WilderSueden25 May 2022 13:15According to the State Building Code BW §4 paragraph (1), in my opinion, it means something quite different. It refers to having a spot where you can access your property from the street. A driveway corner (like we have) is sufficient for this. There is no mention of keeping space free in front.
