ᐅ Garage built taller than specified in the building permit/planning permission

Hello everyone,

In our building application, we specified the garage with a height of 2.68 meters (8 feet 9 inches) for some reason. The garage is properly located at the edge of the property on the area designated as GA in the development plan.

Would it be possible to build the garage 3 meters (9 feet 10 inches) high instead, contrary to the application, or do we have to stick to the approved plans? The construction is taking place in Baden-Württemberg.

The question arises because we are quite certain that we will not actually build a garage there. Instead, a carport is planned, which will be greened. Therefore, we would like to make use of the maximum permitted height.

In our building application (exemption), the carport was only 8m (26 feet) long, but over 30 sqm (323 sq ft). I still wonder how we didn’t notice that the entire boundary development was not fully utilized.

The building authority told us that we would have to submit a new application (also an exemption). They said we would get approval quickly this time, and it would just be filed and archived. Rules have to be followed.

Why, are you allowed more? In B, as far as I know, 8m (26 feet) is exactly the maximum length for a boundary wall. The total length can be 16m (52 feet) (?) but not all in one stretch. I thought that was already the maximum according to the building codes and that local development plans would generally have lower limits...

So, unfortunately, our architect is not certain about this, and since we HAVE to prepare and submit new plans for the authorities anyway, he is now designing the garage with a higher height.

He doesn’t want to take any risks because the footprint is already over 30m² (320 square feet) and therefore requires a building permit / planning permission. We don’t have the maximum length of 9m (30 feet) in our case; the only critical factor might be the maximum 25m² (270 square feet) of wall area on the boundary with the neighbor, but even with a height of 3m (10 feet), we are still within the limit.

Oh, in B it is also 9m (30 feet), and a total of only 15m (50 feet) is allowed at the boundary. Somehow, I misallocated that one meter in my mind... Maybe I thought 8m (26 feet) and 16m (52 feet) made more sense because they represent a 1:2 ratio. Who comes up with 9m (30 feet) and 15m (50 feet)?
