ᐅ Garage built taller than specified in the building permit/planning permission

Hello everyone,

In our building application, we specified the garage with a height of 2.68 meters (8 feet 9 inches) for some reason. The garage is properly located at the edge of the property on the area designated as GA in the development plan.

Would it be possible to build the garage 3 meters (9 feet 10 inches) high instead, contrary to the application, or do we have to stick to the approved plans? The construction is taking place in Baden-Württemberg.

The question arises because we are quite certain that we will not actually build a garage there. Instead, a carport is planned, which will be greened. Therefore, we would like to make use of the maximum permitted height.

Well, we can’t easily answer the question of what is allowed in your area. Here in Bavaria, building on the boundary line is not permitted to exceed 3 meters (10 feet) in height, measured from the natural ground level; otherwise, setback distances must be observed. I don’t know if the same rules apply where you are, or if the natural ground level there was higher than your new garage floor / carport floor.

The question is rather, am I allowed to build up to 3m (10 feet) even though we only submitted 2.68m (8 feet 9 inches) in the building permit / planning permission? Assuming the natural terrain is taken into account.

Note: This is a non-expert opinion. If a building permit / planning permission is required for the garage, then a new application is needed only for the garage. If the area or volume of the garage is still allowed without a permit, then simply build without a permit...

For minor changes like this, there is, for example, a building amendment in the NDS. It costs only a fraction of a building permit / planning permission and also takes less time. I’m not sure if it’s necessary, since 3 meters (10 feet) are generally allowed.
