Hello,

In the development area where we purchased a plot, another builder has registered an easement (building obligation) on an adjacent property. He wants to place his garage right on the property boundary. Almost all plots in this development slope slightly downward from the access road toward the back, including ours (approximately 1 to 2 meters (3 to 6 feet), depending on the plot). Therefore, he raised his house and garage by about 1.8 meters (6 feet) to align them with the level of the access road. For the building permit (planning permission) of the garage, an easement on the neighboring property was required.

The average wall height must not exceed 3 meters (10 feet). We want to place a prefabricated garage with a flat roof on the property boundary. For example, 3.3 meters (11 feet) wide x 6 meters (20 feet) deep x 2.5 meters (8 feet) high.

In the case of a plot elevation of 1 meter (3 feet), do I have to add this to the 2.5 meters (8 feet) garage height or not?

Yes, the fill is counted starting from the top edge of the existing ground level.

I would like to bring up this topic.

We also have a sloped site and want to place a garage on the boundary with the neighbor. I understand the issue with the average wall height and so on. We live in Hesse, so no building permit / planning permission is even required. Because of the slope, we want to maximize the height as much as possible. Now the questions…

The plot has already been raised along the boundary with L-shaped concrete blocks. Is this a problem if the garage is placed next to the L-blocks, so it would no longer be exactly on the boundary?

Could I also go higher, for example 3.2 m (10.5 ft), if I obtain a permit? Does the neighbor have to agree?

And: How much “leeway” is there regarding the height? What if it ends up being 3.05 m (10 ft)? What happens then? There are certain tolerances in construction, sometimes not small ones, right? Is demolition threatened or how are such cases generally handled?
