ᐅ From when is it possible to update the registration?

Hi,

we are currently planning our house construction (hopefully starting in July or August) and have a small issue. Our child will start school this September, but unfortunately not at our future residence, rather 30 km (18.6 miles) away at our current address. We would like to avoid this and, if possible, have the child enrolled at the future residence right away. Applications regarding this have so far been unsuccessful and were all rejected.

Assuming we start construction in July or August, from when would it be possible to change the official address?

According to the law, the house must be habitable, which, according to the Bavarian building regulations, means:
“A building may only be used when it itself, access roads, water supply and wastewater disposal, as well as communal facilities, are safely usable to the necessary extent, but not before the time specified in sentence 1.”

However, inquiries with the residents’ registration office showed that they are not very strict about this (they basically said we should just proceed, as no one checks this closely, especially since it’s just a matter of a few months).

I believe we received those relatively soon after the start of construction. However, since that was well over two years ago for us, I don’t remember the details very clearly.
I just checked the Dresden website, and it definitely states that both the building permit (planning permission) and the site plan are required for the application.

Yes, we both work nearby as well (about 4 km (2.5 miles) away).
However, the application for attending an out-of-area school was rejected—despite providing information about the start of construction, etc.

We already have a house number—some houses are already built there. I think it’s also stated in the purchase contract.

I would also first try to have a personal conversation with the school in the building location. In our case, after consulting with the local authority and the school, neighbors were able to register their child at the future residence’s school even though construction was still ongoing at the start of the school year. They just had to accept the longer daily commute. The neighbors who are currently building will do the same, and the registration process seems to have worked out relatively smoothly.

Within the same municipality?
We are moving from municipality A to municipality B, and the mayor of A refuses to release our child because the municipality invested several million in renovating the school(s) last year and this year.
The school in municipality B would gladly accept our child—we have already had discussions.
They don’t understand the situation at all.

Currently, the only option seems to be the brute force approach—moving into any available apartment in municipality B before the school year starts. But we wanted to avoid that. It costs a lot of money and causes stress, just to have to move again a few months later.

Then just have your child really move in with grandma – before you rent an apartment!? No guest room, study, or anything like that available? The child doesn’t have to sleep there, no one will be checking...
