We moved into our new build in 03/2008 and have now noticed that the floor is sinking in some areas, creating gaps up to 10mm (0.4 inches). Since we have underfloor heating, we assume that the insulation boards are settling.
We are not sure who is responsible for this, us or the house construction company.

according to the Building Code, you have a warranty period of 5 years, and in my opinion, this qualifies as a warranty case.
You should ask your lawyer.
