Hello,
we have the opportunity to buy 2 condominiums in a 10-unit residential building. We have already viewed the properties.
The apartments are being sold through a real estate agent (about 6% commission). Now my question:
If we agree on a purchase price with the seller but the notary appointment is only scheduled for 2021, would the seller have to pay half of the agent’s commission?
Should we take our time with this?

They should have enough expertise for that. However, the purchase contract ultimately only specifies the land registry sheet for the property you are buying. In our attic apartment, the sloping ceilings were also “forgotten.” In my opinion, this was not done maliciously, since all documents only state the floor area. In other words, I wouldn’t even know the living area according to the German WoFIV standard. When we sell our apartment soon, I will therefore only specify the living area according to DIN 277 in the listing on Immoscout.
So, in my view, you were lucky that the agent agreed to it, as it is not their responsibility to verify this. At least, that’s my opinion.
