We are facing the following issue: we are looking for a semi-detached house on the existing market.
Current offer: prefab semi-detached house, built in 2000, roof insulation with a 140mm (5.5 inches) insulation layer (probably a U-value of 0.3).
There is a top floor ceiling that is not accessible for walking.
If we purchase the property for our own use, would we then be required to upgrade it within two years to a U-value of 0.24 according to the 2009 Energy Saving Ordinance?
The representative from the financing bank said this would only be necessary if we rented the property out, which, in my opinion, does not make sense. Have we overlooked something?

Section 10, Paragraph 3 of the Energy Saving Ordinance applies here! The obligation exists regardless of whether the property is for owner-occupation or rental. Alternatively, the roof ridge can be insulated.
However, the obligation does not apply if the costs required for the upgrade cannot be recovered through the savings made within a reasonable period of time (Section 10, Paragraph 6 of the Energy Saving Ordinance).
By analogy, Section 25 of the Energy Saving Ordinance can also be applied.
In both cases, an appropriate expert report is required.
