fraubauer25 Jul 2016 16:56Hello,
I live in a condominium unit in a building with six apartments. It is a new build.
I have a large balcony facing south.
Since there is no overhead covering, I want to get two aluminum posts (same material and color as the balcony railing) from the balcony manufacturer and have them installed at the corners of the balcony railing. Then I plan to attach a sunshade sail between the two posts and fix it above the balcony door.
The posts would be easy to remove. The sunshade sail would only be hung up when the weather is suitable (of course, not overnight).
I also have a neighbor who has a south-facing balcony as well (currently with no covering or other installations).
Question:
Do I need to
a) submit this plan to the homeowners’ association for approval?
b) obtain a permit from the local authorities (building permit / planning permission)?
I am the owner of this apartment.
Thank you very much,
erika

I would definitely present this to the home owners' association (HOA), as otherwise it usually only causes unnecessary trouble. You can explain well that the posts are only there when you have the sunshade set up. However, since it changes the appearance of the house, it can unfortunately lead to discussions. With 6 units, you can usually ask informally and have it briefly acknowledged with a circular resolution.
I completely disagree with the previous speaker.
A sun sail is usually movable, rarely permanently installed.
Therefore, I would set aside the EU regulations and consider the sun sail more like a patio umbrella.
I personally wouldn’t even mention that something is being mounted or turn it into a collective matter.
Just my opinion! Being part of a community doesn’t mean you have to give up your own rights.

Hello,
I have just moved into my condominium and attended the first owners’ meeting.
It’s not really possible to give a general answer. Unfortunately, I have to disagree with you… an awning can change the exterior appearance and, in some cases, may actually require approval. Fortunately, with us, the developer specified right away that no separate approval is needed and it is explicitly allowed.
As for the sun sail, there should be no problem as long as it can be easily removed and does not represent a permanent change.
To avoid any issues, I would recommend asking politely beforehand.
Best regards

I agree with @ypg, I think if you are going to install a large awning, you don’t even need to ask.Yes, Souly is right. Awnings are not allowed without approval from the homeowners’ association, as they are attached to the apartment and clearly visible from the outside.
