Hello everyone,

Is the removal of a temporary construction road normally included in a shell construction contract or excavation work?

Background: I hired a construction company to carry out the shell construction for my extension with a basement. For the excavation, the construction company subcontracted another company, which I later paid directly (not through the construction company). A temporary construction road was necessary for the shell construction/excavation. Now I’m being told that the removal of this construction road was not part of the offer and, if at all, would need to be separately commissioned and paid for.

My question is: How is this usually handled? To me, this would be like a plasterer leaving their tape and protective sheets inside the house after finishing their work and leaving the removal to the homeowner because it wasn’t explicitly included in the contract.

Competent answers are definitely available here, but for that, the original poster (you) needs to provide the necessary information. The question was about what exactly was specified/written in the contract or offer. If you don’t respond to that, you can’t expect precise answers. Guesswork was abandoned some time ago, and the crystal balls have not yet been delivered.

In the other forum, you also didn’t make certain statements that you’ve expressed here (for example, the contractor’s comment “not included in the offer,” etc.). This means that the answers there are more based on guesswork than the answers here.

Also, you seem to forget that the statement you quoted from the other forum is only one of three possible scenarios the user listed regarding how the contract might have been drafted. So, this is only relevant if it actually happened that way, but no one here knows that because you don’t respond to the users’ follow-up questions here.

However, it is obviously easier to interpret the users’ answers in whatever way suits you...

After all, with the statement "so probably happened here," he gave the correct answer. Describing three possible scenarios is not really guesswork. In any case, the right one was included – and that’s what matters.

I actually overlooked the question about the contract content. That sometimes happens to me with overconfident phrasing...

Whether this is actually the right one cannot be determined by us as long as the full description of the contract is not available. If it is as assumed above, you have a chance.

I get the impression that he’s mainly looking for the answer that suits him best.

He was given several options in another forum as well and simply chose the one that fit his preferences.

If someone is too reluctant to provide enough background information, they shouldn’t be surprised if they don’t receive meaningful answers.
