Hello everyone,

I have previously asked several questions about our "chosen," but not yet finally purchased, plot of land.

Now we are moving on to the specific planning of what kind of house can be built there. We originally wanted to build a classic single-family house with an attic, but the maximum building height is reportedly an issue according to the construction company.
8 m (26 feet) is already not very much, and in addition, the maximum height must effectively be reduced to about 7.40 m (24 feet), since the reference point for measuring the building height is the public road, and the access to the actual house plot runs over a narrow strip of land (about 30 m (98 feet) long). Due to the slope that must be taken into account, the maximum building height is reduced accordingly.
The construction company could realize the project, but then there would be no attic anymore. Furthermore, the house would no longer match our idea of a classic single-family home.

What do you think, is this correct? Do you have any ideas on how to solve this problem?

@Escroda Thanks! How exactly do you arrive at the height of 11.73m (38.5 ft)?
Is a combined bike and pedestrian path really considered a main road for planning purposes?

The southern elevation at the bike and pedestrian path is 12.01m (39.4 ft), the northern one is 11.64m (38.2 ft). The middle of your plot is approximately at one-quarter of the distance.
12.01 - 11.64 = 0.37
0.37 / 4 = 0.09
11.64 + 0.09 = 11.73

After all, like the other roads, it also has a street boundary line. But well, that would probably be disadvantageous for you. Maybe the building authority already assumes 12.03m (39.4 ft) or even interpolates 12.04m (39.5 ft). If not, you could argue based on atypical conditions since this access only affects four plots in the entire development area.
