we have purchased a condominium that is currently in the shell construction phase. Attached is a photo of the damaged window.
My message to the developer:
"Unfortunately, I have noticed that the roof window in the bathroom is damaged. It is not just a scratch; the frame is damaged so that the internal structure is visible.
Since the impact on durability and potential problems cannot be assessed, I assume that the window needs to be replaced."
The response:
"The contractor filled the damage with liquid plastic. The double casement window will not be replaced due to the damage.
It can be absolutely ruled out that the damage affects durability or anything similar.
The damage is behind the drywall, which still needs to be installed, and it does not cause any disadvantages there."
How would you handle this?

Alessandro23 Jul 2020 13:41I would at least try to negotiate a price reduction. It is definitely a visible defect since the damage is exactly in the visible area. If they do not agree to this, I would insist on a replacement.
So, if the damage was properly repaired with liquid plastic, a replacement is hardly an option. That would be anything but reasonable. Of course, the assumption is that when I buy new, it is undamaged. But there will likely be no more than a small price reduction, and even that seems unlikely to me.
The developer also confirms this, and since the damage is not visible but hidden behind the drywall, I don’t really see it differently. Although I understand the frustration, you are not actually suffering any loss, provided the repair was done correctly. I would consider getting that confirmed, but you probably won’t be able to get much more than that.
