Hello everyone,
Our general contractor agreement states that the property will be ready for occupancy 10 months after construction starts, with the completion date set at 12 months.
However, we want to phrase this clause so that the property must be ready for occupancy within 2020 under any circumstances, as otherwise we won’t qualify for the homebuyer subsidy. Another issue is that the site development work is still ongoing, but according to the project manager, it should be finished by September. This also needs to be included somehow in the clause.
Can anyone knowledgeable assist here?

goalkeeper31 May 2019 08:38Our general contractor now phrases it like this. I’m not sure if I should be excited about it yet:
Construction is scheduled to start on October 1, 2019, provided that the site development work is completed and the construction area is available, as well as the possibility to submit the building application under the notification procedure by August 1, 2019. The completion date is then set for November 30, 2019.
The municipality will automatically grant the building permit four weeks after the site development is finished—no problem. However, no official source is stating when the construction area will be completed.
The supervising site manager mentioned that they will be finished a few weeks before the actual deadline on September 30.
There are quite a few “ifs” everywhere. We might have to give up on a fixed completion date after all.

HilfeHilfe31 May 2019 08:43Well, what did you expect? You wanted to shift your risk onto the main contractor, and your main contractor shifted it onto the municipality. This is a classic risk transfer, but it doesn’t help you since you have no legal recourse against the municipality.

Strahleman31 May 2019 09:05What happens if you need 8 weeks to select the flooring and 10 weeks for the bathroom fixtures? Does the completion date still apply then? I think it's quite generous of the general contractor (GC) to even guarantee a possible completion date and not include any active involvement or support from the client in that.
Does the contract include a completion guarantee? For me personally, that would be much more important than just a completion date.

Does the contract include a completion guarantee? To me, that would be much more important than just a completion date. The selections must also be finished by 09/30/2019. This is stated in the contract.
