Hello everyone,
here is the issue:
We purchased a penthouse apartment in January, which is still under construction.
The apartment is on the fourth floor and set back approximately 1.5 meters (5 feet) from the lower floors.
This week, a stainless steel exterior chimney (2 pipes) was installed about 35 cm (14 inches) next to our bedroom on the outside wall,
so whenever we look out of the bedroom window, the chimney is directly in view.
The chimney was not included in any plans or house elevations!
Attached is a picture for illustration.
Since it seems that nothing can be changed, it will probably come down to compensation. What options do we have here?

We are on the top floor, and the pipes are attached to the house wall with some kind of steel brackets...
I suppose they forgot about this during the initial planning... in any case, there is no chimney shown on the buildings in the plans and elevations that are part of our purchase contract (2 buildings with a total of 28 apartments).

See the other forum. You won’t get any different answers here either... ;-)

What do the plans show? You probably double-checked whether the chimneys were really marked there?

Personally, I can’t imagine there would be a significant deduction due to a "view obstruction" because the quality of life inside the apartment is not affected. There is no rooftop terrace planned there, and the chimney is not built directly in front of the window, but beside it.

Still, one of the reasons for buying a penthouse apartment might be the unobstructed view of greenery...

If anything, I would be concerned about smoke on windy days and the chimney sweep’s access if they need to enter your apartment.

The chimney can be directed sideways a few meters below you at a 20-degree angle so that it no longer causes any disturbance. Its exit point at the roof probably doesn’t matter.
