ᐅ Before Handover – Tree Falls onto Neighboring Property

Hello,

I signed the purchase agreement with the notary for a house and land three weeks ago.

During the last inspection, I noticed a dead tree, a huge conifer that is already hanging halfway over the neighbor’s property. The house has not been paid for yet; I expect the payment to happen by the end of February. I informed the seller, who was already aware and said he would take care of it. However, nothing has been done. I feel like the seller wants to delay the issue.

Question: Can the seller hand over the property to us like this, or is he required to fix the situation before transfer?

You will hardly be able to force him to fix it properly. Ring your neighbor’s doorbell and do him the first favor by taking care of the tree first. A very worthwhile investment in the long run.

I would probably just wait it out as well. If you don’t buy, someone else will be happy to. Whether there is a tree standing, lying down, alive, or dead…

Simply put: what does the contract say?

If nothing is stated and no agreement has been made on this matter, you are responsible and liable for any damage caused by the tree.

Good grief... It was just a question, partly because from March onwards no trees are allowed to be cut down, and there are quite a few standing that need to be removed from the path... good luck

Good grief, all these moral complaints and misinformation—did you read the question? The property does *not* belong to me yet. I would like to get this sorted promptly; waiting definitely won’t improve the situation.

By the way, where does this tendency come from that when questions are asked, the questioner is attacked first? As if saying, “You messed up”…?
