Hello,

our builder wants 65,000 euros for a basement (75 m² (807 sq ft)), KfW 70 standard. We have now found a company that could build the basement more cheaply, but our builder refuses. According to the builder’s scope of work, it is allegedly not allowed to do the basement as self-construction or through another company. However, we do not have this scope of work document. My question is: Can the builder prohibit us from having the basement built by someone else? Or should I consult a lawyer?

No... it’s less about "forbidding" and more about "liability." However, under the conditions you mentioned—unless you want to build a fully finished basement with all the extras—I would suggest dismissing the contractor. A lawyer can only help if contracts have already been signed—you cannot use a lawyer to impose a detailed scope of work on any provider beforehand; it’s a matter of supply and demand 🙄
