ᐅ Development Plan Private Road – Rights and Responsibilities

Hello dear experts,

we have a reservation for plot 242/3 (single-family house). I am wondering what I should make of the information regarding the private road marked in yellow. What rights and responsibilities come with this? It is already established, but what exactly does “private” mean here? Is this the access road to our property? And is no one else allowed to drive on it? Am I responsible for maintaining and repairing it?

If the street is already in place, you at least don’t have to build it yourself. Whether you need to acquire it alone or together with your neighbor, I’m not sure. Based purely on appearance, I would say you alone, since the neighbor can also access their property directly via the public road; in any case, it provides you with access. You can probably maintain or neglect it at your own discretion, and likely replace the obligation to clear snow with an “at your own risk” sign. I see that you would need to organize the service of rolling the trash bin to the public road yourself. You don’t have to be complacent about it; you can issue warnings to loiterers yourself. The seller should be able to give you the most accurate information.

I assume your neighbor on the right side can choose which access route (here: entrance/access road) they want to use?

Take a look at the textual regulations in the development plan; it should specify who is allowed what and who isn’t. Otherwise, it’s likely that no winter maintenance or road services will be provided here, and garbage collection will not take place at the house. The general traffic regulations do not apply either.

Also, check the state building code of Baden-Württemberg, as that is probably the relevant federal state, or the road traffic law, where the term “private road” with all rights and obligations should be explained. If in doubt, contact the local building authority.
