We have acquired a plot of land and are now looking for an architect to design our house. After extensive discussions with relatives and friends about recommended architects, we had a non-binding meeting with one architect on the property yesterday. After briefly explaining our wishes and outlining his services, he informed us that he does not invoice according to the HOAI fee schedule. Instead, he divides a flat fee of about 10,000€ plus VAT into three invoices for three “construction phases.”
We are planning a “simple” single-family house with a basement, approximately 12x12m (39x39 feet) in size. At the meeting yesterday, his estimated price for the house was around 300,000€.
According to our online research and the HOAI fee calculation, we would have to pay about 25,000€ under HOAI.
It seems we can get the same services for less money.
Do we face any risks or disadvantages if the architect does not charge according to HOAI?

Yes, fixed prices below the minimum rate violate the HOAI and are invalid. But where there is no claimant, there is no judge.

The plan is for a ground floor with a finished attic, as only one full floor is permitted, plus a basement.
The price estimate was only a rough approximation during a verbal conversation. Nothing that I will refer to later. I prefer clear statements rather than phrases like “it always depends on what you want” or similar. As long as someone builds straightforwardly with a certain level of luxury (electric blinds, etc.) and doesn’t want a golden toilet, a rough estimate based on experience should be possible. Considering the construction costs of others in the region with comparable buildings, which have been around €250,000 (about $270,000) in recent years, his figure seemed very realistic to me.
