Hello everyone,
here is the issue:
We purchased a penthouse apartment in January, which is still under construction.
The apartment is on the fourth floor and set back approximately 1.5 meters (5 feet) from the lower floors.
This week, a stainless steel exterior chimney (2 pipes) was installed about 35 cm (14 inches) next to our bedroom on the outside wall,
so whenever we look out of the bedroom window, the chimney is directly in view.
The chimney was not included in any plans or house elevations!
Attached is a picture for illustration.
Since it seems that nothing can be changed, it will probably come down to compensation. What options do we have here?

Why can’t it be changed? You can move the chimney to the exterior wall, right? And then have it run flush up along the wall?
What can be used as a vent?
How much is the view worth to you? Everyone has a different “value” in mind here. I would value it at 50% of the purchase price because, for me, it’s an absolute dealbreaker. Others might not be as bothered and could be happy with something like 500 €.

What value can you assign as a deduction?

Others might not be as bothered and might be satisfied with 500 €,...I was told that a chimney is only allowed to have one bend of up to 30 degrees, here we would need 2 bends of 90 degrees each...
However, they are still checking what the solution could be, possibly bricking up windows.....

Even if they brick up the window, that bare, ugly pipe will still ruin the entire building’s appearance. How does the pipe continue upwards? You probably live on the top floor? How is the pipe secured against wind (to prevent bending)?

So you would be okay with someone bricking up your bedroom window? That would be a no-go for me, just like those "aesthetically pleasing" pipes in front of the window.
Why is a fireplace suddenly being added when, according to the plan, there wasn’t one at all? Or were the pipes originally supposed to be somewhere else?
