Hello everyone,

We found our construction company through recommendations. After comparing several providers, we ultimately decided on this one. An important factor was to have the same site manager as our acquaintances, who highly praised him. We made sure this was contractually agreed upon.
Now we have received the order confirmation from the company, and the next day we were informed that the requested site manager is not available, as he has recently settled in Bavaria and would have to travel 5 hours to reach us. However, there are two alternative site managers in our area.
This is not a minor issue for us and immediately reduces our trust in the project from the start.

Question: As clients, do we have to accept this? Can or should we already demand compensation? If so, how much? Or is there nothing we can do?

Is the company willing to engage in a conversation? If so, one option could be to negotiate the coverage of costs for a construction manager of your choice...

The proportionality is not given, unless the construction manager is some kind of star in his field.

What is really frustrating is the assumption that some people here immediately accept it as normal at all levels that the contractor can ignore contractually agreed details just because it costs them more than they estimated or it doesn’t fit into the schedule...

Well, we haven’t actually seen the exact contractual agreement from the original poster either. Often, people interpret contract wording in a way that doesn’t hold up later.

Exactly. And without proper knowledge, people immediately say, "Forget it, the company doesn’t have to comply, it’s unreasonable if the person lives in Bavaria."

You may have your strong opinions about site managers employed or appointed by construction companies and believe those opinions are absolutely correct... fine.

But a contract is a contract, and you want what is agreed on in it to be delivered.

Otherwise, we might as well go back to the good old handshake days, where one or both parties just do whatever suits them 😉

PS:
Our clients also like to cancel orders when we guarantee person X and in the end, person Y is supposed to come instead...
