Hello everyone,

I have a few questions that might also be interesting for other home builders, and I hope you can share your knowledge or experiences.

As far as I understand, a general contractor (GC) can carry out certain construction tasks—such as tiling or drywall installation—without a special qualification, since these professions are not subject to master craftsman requirements. However, for skilled trades that require a master craftsman qualification, like masonry work, the GC is only allowed to perform these if they themselves hold a master certificate or employ a master mason in the company. Is that correct, or are there exceptions?

I am also interested in the legal situation regarding developers. From what I understand, the developer is usually the client in a legal sense. Private individuals are allowed to do many tasks themselves as clients (such as structural work). Does this apply to developers in the same way? Or are there specific rules about self-performed work on construction projects?

I recall that with my brother’s project (which was built through a developer), the owners of the construction company did the masonry themselves—even though I believe they did not have a master certificate. Is this legally permitted, or is it just “tolerated”?

And one more question regarding terminology: Can a developer act as a general contractor (GC) at the same time? In other industries, like insurance, there are clear distinctions between brokers and agents. Is this regulated in the construction industry by the business registration? Does a company have to explicitly register as a developer or as a GC/prime contractor, or can these titles be used simultaneously?

"General contractor" is not a profession but a legal status in relation to the client. A general contractor submits a comprehensive bid in response to a tender, including packages from other trades, which are then fulfilled by subcontractors. The executors (the general contractor, their employees, workers, and subcontractors) are, of course, not exempt from any required certification or licensing obligations. The general contractor themselves or a licensed employee is usually a certified master tradesperson in masonry and concrete work, or in timber construction for wooden buildings. Any provision of services for third parties is considered a commercial or freelance independent activity. Therefore, a journeyman or even a layperson is not permitted to carry out masonry work on behalf of others.

A property developer is essentially a general contractor and client combined in one person or entity. Many large general contractors have developed according to the concept similar to the endosymbiotic theory and are involved, partly due to workload management, as property developers and land developers.

In insurance and financial consulting, the trend is clearly towards multi-brokers and fee-based advisory services. Even Günter Kaiser from the commercials of my childhood and youth is no longer an agent with ERGO. Here, the "master craftsman certificate" is §34(c) Gewerbeordnung (Trade Regulation Act).
