Hello everyone,

Yesterday, we received a letter from the city hall requesting that we remove the barriers and the crane from the street by November 30, 2023, as our previous permit apparently expired some time ago.

They also mentioned that unfortunately our general planner is unable to comply with all the regulations and orders and does not consider themselves responsible for the traffic-related requirements. For this reason, no new traffic-related permits will be approved for the time being.

Our general planner says that there was only a broken lamp, which was replaced on the same day. Could this really be the reason for this decision?

I will definitely speak with them to try to get more details about what went wrong with the general planner. Do you have any suggestions on how to resolve this conflict? Is there anything I should specifically monitor? Would it make sense for me to visit the construction site and ensure that everything is running smoothly day and night?

Tomorrow, I will also ask the shell builder how long the crane needs to remain on the sidewalk, but I am not sure what can be done if the city hall does not approve another extension.

Thank you very much
Best regards

Welcome to German bureaucracy. The rigid officials will be thoroughly challenged.

I always thought that especially supporters of the AfD have a strong interest in law and order? Well...

So, what happened? Apparently, there has been a crane standing in a public area for a long time without a valid permit, because it has expired. The local authority has been quite lenient here by allowing it until November 30.

Of course, the general contractor (GC) can tell you all sorts of things. The broken lamp could also be considered a suspended load that hung there on the hook above the sidewalk for three days.

The important thing here is to discuss the matter calmly and factually, and also to recognize that the fault primarily lies with you (the GC or yourself, depending on who was responsible for obtaining the permit)... if I don’t renew a no-parking zone in time, it has to be removed, that’s just how it is.

Who submitted the application? That person should resolve the issue.

Is the roof already installed?

Yes, that’s true, they were very lenient after the previous permit expired.
This is something I hope to handle myself (easily) in the future.

But that doesn’t seem to be the main issue when reading the other comments about non-compliance with all regulations and orders.

Yes, I would try to get clarification from the city hall about what really happened. It could be something even worse.

Certainly, but I’m trying to understand what my duties are normally or what the authorities expect from me. Am I supposed to visit weekly to check if everything is okay? Or should I do that daily?
If something is broken, wouldn’t I ask the main contractor to fix it?

Since I am the property owner, the permit is in my name. But the general contractor handled all preparations and was listed as the contact person.
I think in the future I will also have to list myself as the contact person.

No, they are still working on the basement. We had long delays because there were issues with the excavation.

You will probably need to find out exactly what went wrong, apart from the missing extension. Until then, it's all just speculation.
And you have already learned something important. Even if the general contractor fills out the applications for you... you sign them, and in the end, you are responsible.

At the very least, I would visit my construction site weekly, regardless of whether there is a crane on the sidewalk or not.
