ᐅ Building Energy Act Calculations – Are They Required? And Who Prepares Them?

Hello friends,
So far, we do not have an energy performance certificate or calculation for our new build (single-family house, not for rental). The architect planned with 36.5 bricks, there is a ground-source heat pump, and a central ventilation system with heat recovery.
The general contractor building for us says they never do the energy performance calculation.
The expert we hired to inspect the build (starting in October) says that a calculation is necessary, at least to correctly select insulation materials, wall thicknesses, etc., and that it should come from the general contractor.
Now I am confused, so here are my questions:
1. Who is usually responsible for this?
2. Do I have to commission it myself? From what I understand, I must of course comply with the energy performance regulations / building energy law, but no official from the city where I am building will actually inspect or measure anything inside my single-family house after it is finished, right? And I would only need proof when selling or renting it out – correct?
3. If it is not possible without the calculation, how much does it roughly cost? Can someone share their experience?

That's why it might be the case that, under the current Building Energy Act, meaning the minimum standard, it does not have to be specifically demonstrated. This is just a thought and speculation on my part, nothing more. I doubt that, since the DIN is a technical standard, whereas the Building Energy Act falls under public law.
Anyway, I couldn’t quickly find any requirement for submitting proof of compliance with the Building Energy Act in the Bavarian State Building Code. In North Rhine-Westphalia, this is regulated.

When and how this is regulated depends on the states; you can find this for NRW in the "Regulation for the Implementation of the Building Energy Act."
This is the state regulation for NRW, but the TS is from Bavaria, so this does not apply.
According to the Bavarian AVEn (§2), the local building authorities (building departments) are responsible for enforcing the Building Energy Act.
In §5 paragraph (1) it states that before construction begins, a declaration of compliance (whatever that may be) proving adherence to the Building Energy Act requirements must be submitted. This is probably something like a thermal insulation certificate?

But no matter the federal state, you probably can’t get around it because of federal law. I looked it up a while ago since our energy consultant was reluctant and not very forthcoming with information.
