If a roof terrace in a condominium has defects, does it count as individual or common property?
If this roof terrace also serves as the ceiling of the apartment below, how is the ownership classified then?

Normally, a standard ceiling is considered individual property. But in this combined case of a roof terrace that is also the ceiling of the apartment below?

fach1werk18 Nov 2020 20:29Check the declaration of condominium. At least the coverings and waterproofing are often the responsibility of the individual owner (maintenance obligation). Otherwise, ask the property manager. I don’t know any woman who writes like that; it has nothing to do with being a retiree 🙂 Best regards Gabriele

The property management also has no documents or expertise.
Is the property manager allowed to request all construction documents from the builder?
My neighbor is now naturally concerned about his roof terrace regarding consequential damages.

Ceilings and wall plaster/paint are my separate property. The load-bearing wall and the concrete ceiling are common property. The tiles on the roof terrace are separate property, and everything underneath (the structure of the roof terrace) is common property because the roof terrace is part of the building envelope.
