Hello,

I am planning to extend my parents' house, and I have a question: What are the rules for building onto an existing house? Am I allowed to build higher than the current building without causing any issues? I already have a provisional building permit / planning permission, but I want to build higher or raise the attic so that it can be used. Is that possible?

What exactly is a "provisional building permit"?

I assume there is something like a development plan, and if not, you must submit a plan that needs to be approved. I can hardly imagine that you are allowed to build higher just like that.

So the mayor and the city council were there, and I explained what I want to do. They said yes, that I am allowed to do it and that it wouldn't be a problem to start. So I have an oral approval, but nothing more.

It’s like this: my parents’ house is there, and I want to build on it, just raising the wall higher so I can use the attic. It doesn’t make sense otherwise because here, developed building plots are not sold, and no one is offering any building land. So I’m building at my parents’ place and trying to make the best of it, and that’s only possible if we build higher.

No idea what is allowed or not where you are, but never without written permission 🙂

Whatever the mayor has told you verbally – don’t take it for granted until you have the written approval from the building authority responsible for your area. If there are any issues, you should remind the mayor of his confident statements.

Find an architect you trust – you will also need a surveyor for the preliminary site plan. Together with the architect, you can then design the future floor plan and prepare the building application, then you have to wait.

Anything else will not work!

Thank you for the replies. Yes, Bauexperte, I know Neukirchen very well, that’s nice 😉 it’s like half Bavaria from my area. Yes, I will definitely discuss this with an architect. Is it also possible to get a non-binding quote?
