ᐅ Incorrectly installed main utility lines

I have a concern. The underground pipes were installed incorrectly; unfortunately, they do not end up in the utility room but in the kitchen. The problem is that the foundation slab has already been poured. What would be a proper professional way to remedy this defect?

I find the wording of the email perfectly acceptable. After all, we are dealing with a business relationship worth several hundred thousand euros. Such phrasing should certainly be interpreted professionally, which the site manager here apparently did.

The plumbing specialist actually caused the problem. He is responsible for the main drainage pipe and hired a subcontractor.

Unfortunately, as I already mentioned by phone today, I had to find that the wastewater pipes in the foundation slab are shifted by about 1.10 m (3 ft 7 in) from the construction plan. I assume that you will arrange for this error to be corrected. Please understand that as the client, I will not accept the current state and will insist on the construction work and planning as contractually agreed between us.

A warning can be issued if construction continues despite an error and the invoice has already been sent. Although the site manager gave a dismissive response, after being notified, they still need to check the issue. In my opinion, there is no reason to send a formal reminder at this point.

As the client, you have the right to a properly constructed house. However, sometimes—actually, often—rework is necessary. This means that the client sometimes has to remain patient, voice concerns, but wait until the issue can be resolved.

Immediately claiming a defect and stopping construction is the wrong approach.

But after reading this forum, it seems like every second person rushes straight to a lawyer.

I don’t want a work stoppage or a lawyer either.

I just want a house without defects or with only very minor ones. I am paying a six-figure amount for that.

I have only noticed that the site manager is not fulfilling their responsibilities > supervision. They were on site but did not notice the defect.

I understand that you only had the conversation with him last Friday.

In any case, it’s wise to stay vigilant! If you have the opportunity to check more frequently, do so. However, I would recommend a more cautious approach and see if the people involved address the issue themselves. Of course, intervene before it’s too late.

Surely, you don’t want your manager to criticize or reprimand your work before the file is closed, the client is contacted, or the product moves to the next stage on the line.
