ᐅ Does this mean a ban on fireplaces?

Hello, after a long search we have finally found a plot of land in our town. The development plan states the following:

The use of air-polluting fuels for heating and combustion purposes, such as heating oil, as well as solid fuels according to § 3 Abs. 1 Nr. 1-8 of the 1st Federal Immission Control Ordinance (for example, wood, coal, lignite briquettes, etc.) is prohibited, as a clear and disturbance-free exhaust of gases is not possible due to the dense development. The use of clean heating energy sources (such as district heating or gas) is encouraged; the necessary supply systems can be provided by the local utility company. The use of solar energy is also recommended.

Does this mean we are not allowed to install a fireplace? We do not intend to use it for heating the house, just for ambiance.

Currently, the offices in Bavaria are closed due to a holiday, so I am asking here.

At first glance, it does seem like you are not allowed to install a fireplace. On the other hand, from my experience, it’s always better to have such texts interpreted by someone working in the authorities themselves—sometimes there are real surprises. 🙂

I believe my “colleagues” here have similar experiences, which is why you haven’t received an answer yet. Therefore, I would advise you to be patient until the building planning office responsible for you is staffed again.
