sauerpeter2 May 2017 13:52Hello everyone,
The confirmation of receipt for our building application includes the following statement:
“The T-30 fire-rated door between the utility room and the garage is not allowed. If the door remains, the garage will trigger setback clearance requirements, which must be legally secured. The necessary changes must be made and submitted accordingly.”
Does anyone know about this? For context, it is a boundary garage, and all regulations according to the building code have been met. Our construction company is not familiar with this issue, and they currently have a building application for another boundary garage with access to the house, where there are no such conditions.
When I asked, the case handler referred to §8. However, I cannot find anything like this there, not even close.
Can someone help us? Is it common for one case handler to handle this differently from another? They are supposed to follow laws and regulations.

Hello,
what exactly is the problem?
Are they complaining because there is a door there at all, or just because it’s a T-30 door?
If the building authority continues to be inflexible: remove the door from the building permit / planning permission plans, but already include the door lintel in the working drawings for the later installation of a door.
Best regards,
Andreas

AndreasHello Andreas,
the issue is that any door, regardless of the type, is not permitted. She said that as soon as a door connects the house to the garage, it counts as a single building. However, there must be two separate buildings.
The idea with the lintel is good, but then after moving in and final inspection, having to break everything open again to install the door? I’m not sure if there is also a random inspection by the building authority where this could be discovered. Would that then theoretically need to be reported as well?

Hello,
if this
is really the issue, it’s not only about the door but probably mainly because you want to build the garage as part of the house. If the garage doesn’t have its own wall facing the house, it’s not separate and therefore considered part of the house. Maybe plan a separate wall facing the house? It doesn’t have to be thick.
Best regards,
Andreas
